By accessing or using the services provided by FreshSitez ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. FreshSitez is a proprietary brand identity owned and operated by MayWenti LLC. If you do not agree to these terms, please do not use our services.

2. Services Overview

The specific services provided by FreshSitez are those described on our website and marketing materials. These services may include website design and development, templated site deployment, GoHighLevel CRM and automation setup, and related digital marketing services for home service and contractor businesses.

3. Use of Website and Services

Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use our services. By using our services, you represent that you meet these requirements.

Permitted Use

You agree to use our website and services only for lawful purposes. You may not: provide false or misleading information; impersonate any person or entity; interfere with or disrupt our services; attempt to gain unauthorized access to our systems; or use our services for any illegal or fraudulent purpose.

4. Subscription and Billing

Recurring Billing: Services are billed on a monthly recurring basis at the rate agreed upon at time of purchase, processed through Stripe.
Non-Binding Previews: Any preview website or proposal provided by FreshSitez prior to payment is preliminary and provided at no obligation. Final service terms require mutual agreement and completed payment.
No Obligation: You are under no obligation to accept any quote or proposal we provide. All transactions are voluntary and require mutual agreement.
Pricing Changes: We reserve the right to adjust pricing with 30 days' written notice to active subscribers.
Non-Refundable: All fees are non-refundable unless otherwise stated in writing.

5. Disclaimers and Limitations

No Guarantees

While we strive to provide high-quality service, we make no guarantees regarding: specific lead volume or business results; uninterrupted access to our website or services; or third-party platform availability (e.g., Vercel, GoHighLevel).

As-Is Service

Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, MayWenti LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, even if we have been advised of the possibility of such damages.

6. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of MayWenti LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

Upon active subscription, you receive a non-exclusive, non-transferable license to use the website we build for you. This license terminates upon cancellation of services. You retain ownership of your own business name, logo, and content you provide to us.

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

8. SMS/Text Messaging Terms and Conditions

FreshSitez (MayWenti LLC) complies with all applicable A2P messaging regulations, including the TCPA and carrier-specific requirements.

Consent Requirements

By providing your mobile phone number and checking the mandatory consent boxes on our forms, you provide your express written consent to receive text messages from FreshSitez at the number provided. Consent must be explicitly granted through checkboxes; providing your phone number alone does NOT constitute consent.

Message Types and Frequency

Messages include transactional updates (project milestones, site delivery notifications) and optional marketing communications. Transactional frequency varies by project activity; marketing is limited to 4 per month. Message and data rates may apply.

Opt-Out & Help

You can opt out at any time by replying STOP, END, QUIT, CANCEL, or UNSUBSCRIBE to any message, or by calling 818-824-8812. Reply HELP or INFO for assistance. Carriers are not liable for delayed or undelivered messages.

Privacy and Data Sharing

Mobile information will not be shared with third parties/affiliates for marketing purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

9. Third-Party Services

Our services integrate with third-party platforms including GoHighLevel, Stripe, Vercel, and others. We are not responsible for the actions, outages, or policy changes of these third parties.

10. Indemnification

You agree to indemnify and hold harmless MayWenti LLC, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

11. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website.

12. Termination

We may terminate or suspend your access to our services at any time, with or without cause, with or without notice. Upon termination, your right to use our services will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and MayWenti LLC regarding the use of our services.
